I am from India, but was born in Kenya, so I won't have immigration issues for long. But, is it possible to get it while on OPT ? I didn't get my H1B selected last year after graduation from USC. I am targeting one of the fangs once I get my green card. But is this a good strategy ? I've heard that one can get green card on opt while not on H1-B. We all know that Cisco is an H1B sweatshop, so they have no interest in sponsoring my green card and waste all that energy . I do not plan to travel at all from the US in the next few years. So, is it safe for a FANG company to do my green card on Post opt

Even if you had a PhD, what could be the justification in EB category when you have no experience that puts you ahead of residents/Americans?

You need to justify why a foreigner should be given employment when you apply for employment-based GC. You're free to apply in any category, but what lawyer representing an employer would be able to justify that they couldn't find a resident new grad to do a job? That's why people get a couple of years stint in before applying. Capiche?

      Hmm, valid question. I concur.

H1B and GC are two separate things. H1B is not a requirement to apply for GC. But if you don’t get GC approved before your opt expires you have to stop working and leave the country so that’s why a company like Cisco will probably not spend the money on your doubtful situation.

F1 is a non-immigrant visa. Don't think they can be sponsored for a green card unless it's through marriage. H1B might not be a requirement, but a dual intent or immigrant visa is a requirement if you plan on adjusting status to permanent residency through your employer. So, OP can't be sponsored until they're off the F1 and on a visa that allows immigrant intent - most commonly H1B.

It's definitely possible to file to EB GC on F-1. The main drawback is that the person will now have to file taxes with 1040 / 1040EZ instead of 1040NR / 1040NR-EZ (they have to pay more taxes).

I didn't do anything to get offers yet. I was just making sure I submit my paperwork to enter the lottery again. But I feel like it's a waste of time, I know that fang companies are supportive when acquiring green cards without H1B, I am just wondering if it's safe to proceed without H1B . I don't plan on travelling from the US

I do not think you can do GC on OPT. You need to get H1 before you apply for GC.

It is allowed but most companies won’t do it cuz it’s apparent your stay is dependent on H1. OPs case of GC is different being born in Kenya I presume. One of my friends had GC filed before he even joined the company.
