Amazon - Should I join on Receipt - Help

Nov 21, 2018 46 Comments

I am considering joining Amazon on receipt since the H1b approval process can take up to 6 months. I wanted to know what you guys think about my chances of getting rejected for H1b transfer. Here is my profile:

-MS, Electrical Engg. and MBA from US universities.
-10 years of experience in Electrical Engg firm in US, Never faced any H1b renewal issues, visa interviews at consulate lasted less 5 mins each time.
-Approved I140 from current employer.
-Wife has H4 EAD
-Have a kid, who is a US citizen.
-Job profile at Amazon requires electrical engineering experience with 6+ years experience.

Your thoughts ? Appreciate your opinion .

I will check with Fragomen, but i wanted a neutral opinion too.

You can talk whatever you want and think whatever you want. At the end of the day it only takes some mad idiot to reject your h1b.

I'm in the same boat as you are. Joining Amazon soon. But I'm willing to wait until approval.
There doesn't have to be a reason really. To quote some though - uscis people not being technical enough to understand your work, being racist, psycho, or being lazy bastards etc. All these are grounds for rejection

While that could be true, have you seen any cases similar to mine getting rejected

Yes, I've seen my high profile friends at faang get rfe for no reason. No rejections but i always assume worst case.

I have not checked with HM yet, planning to do that soon, but all the indicators I received during the interview suggests they really need someone to start ASAP.

In my case they were okay with waiting.. But when lawyers said 4-9 months they freaked out.. There's a possibility of premiun not opening in February

My team said they can wait. But is it really taking 4 to 9 months?

Lawyers wrote 4-9 months in email.. Fragomen.. Now they are bit reluctant to wait

Risk is too high. USCIS probably doesn’t care that you have an H4 EAD wife and a US citizen kid. If you are rejected your wife will lose her job as well.

Do people of Indian descent just not know how to use the search feature? There are literally thousands of duplicates of this EXACT question. The specifics of each individual case are immaterial.

    • New monomo
We do. We do know very well. The point is people of your descent may not know that things with H1b always change, and 90% of the time for worse. That's the reason we keep posting the same questions from time to time. To stay "updated".

It is very sad that a lot of non immigrants are unaware of the whole process which brings their colleagues /managers/ friends etc into the country

From time to time? There were 3-4 posts just today. In each and every one of those, the answer is the same (but the OP never listens): the Trump administration is still defined by its xenophobia, USCIS/ICE/HS are run by anti-immigrant political appointees, joining on receipt is a very bad idea, there are severe consequences if denied and you need a backup plan, your individual circumstances or personal sob story makes no difference, etc.

Update - I did end up joining on receipt . H1b transfer applied on Jan 10th , joined on receipt on 20th Jan , received the h1b approval notice today !!

  • I doesn’t matter what others thoughts are nobody can guarantee you will get approval. You need to understand the risk of joining on receipt. On paper ur case does look good but based on current affairs you never know. Talk to amazon and ask them if they can wait, what your options are if things go bad. All the best

I'm also joining on receipt. Can you tell me if fragomen gives their opinion? In my case they refused to take a stand

In another week or so? They are being very cryptic. All they sent me is a email with 2 options telling me pros and cons, which are from company 's perspective.

Same here, they magically came up with a number that said denials are less than 1%
      Nov 21, 2018
    • Parallon Hellyah
Correct.. I don't know how they came up with that number.. Also I wanted to know denials for my position. Not overall amazon

They refusing to take a stand sounds little scary. In my case they pushed me to join on receipt. I dint feel like taking the risk anyway

“Also I wanted to know denials for my position.” Lol looks like you already made up your mind and looking for some confirmation. Don’t complicate things. depending on your personal situation, just ask yourself if you are ready for the worst case and go for it.

Isn’t the RFE process no more around now ? Starting Sept 10, the visa either gets approved or rejected. You need to submit all docs correctly at the first go.

So many good engineers lack common sense. Chance of rejection is low but there is chance your application might be rejected.. so why to take a chance.. if you have a job u can always wait 4-5 months to get approval.

I think it is more about the new company not being able to wait for that long

To your point about having past smooth visa renewals - Like mutual funds, past performance isn't a good indicator of future. All those receiving denials are folks who had their previous renewals and job change happen without issues.

The question isn't about whether you will receive denial, the question is what will you lose if you go out of status. That is the metric needed to evaluate whether you have plan b and your plan to mitigate risk.

Is there risk of denial - hell yes. Folks who should be fairly clean renewals are getting into trouble. But I think that's not what you are asking.

There is always some risk.. but in that case Amazon should be able find similar role in Canada or any other location if you are up for it - good luck!!
