I am an L4 Program Manager and I am joining a company in California but i have signed an Amazon non compete agreement. I have a clause in there that states i cannot seek employment with a competitor for 18 months after leaving Amazon The legal team from the new employer has specifically asked me if i have a non compete agreement with Amazon. Should i say no? Is there a way for them to find out if i am telling the truth? The job description matches 50% with my current role Thanks
It won’t matter until you are a director or something. Don’t you see so many moving away from amazon and joining else where. Everyone at Amazon signs non compete no exception.
Are you sure you’re not thinking of the non-solicit agreement?
Nops Non compete agreement states that i cannot work for a competitor for 18months after leaving Amazon
If they have asked explicitly then tell the whole truth and discuss with the legal team about the NC wording etc. They might change title/Division etc. Rule of thumb: Never be in a situation where you quit your current job and the new company has valid reasons to rescind their offer.
I wont quit job until i get the other one
Thinking of joining Amazon, what's the non compete like? Does it only apply to your area or all of Amazon's business?
Non competes are not enforceable in California
He doesn't have to. He can compete with a non-compete in California regardless. If he was with Amazon in CA they wouldn't be allowed to make him sign one.
Don't lie. Even if you tell the truth later on, it will not be believable.
You've been asked about this directly. Do not lie-- tell them you have a non-compete. They may just want to get a legal review.
Those are illegal in CA. Do whatever you want in CA.
I am not sure why my new/potential employer is reviewing my non compete agreement with their legal team if it is not enforceable in CA That is really strange
CYA and uncertainty, probably. If you're from out of state they may be slightly more cautious. But it doesn't matter. A CA resident is subject to CA law. They would have to sue you in CA, which is where (a) you reside, and (b) the "damage" occured. A CA judge would then throw it out.
Employment agreements that prevent you from finding work are unenforceable. If Amazon gave you extra compensation for the non-compete like additional stock etc then Amazon can ask for that back.
Why lie? Noncompete should not affect your ability to get a job.
Actually they do I have a clause in there that states i cannot seek employment with a competitor for 18 months after leaving Amazon
