A friend of mine got arrested for DUI and shrroms posession while driving from Burning Man. He says it may cause issues with his future employment because of background check. I think he will be fine, because you’re not a truck driver, and having DUI shouldn’t affect your ability to code. So what’s the impact of DUI ? what’s the impact of drug posession on his future employment ? What types of criminal records may affect employment of a software engineer ? Thanks! P.S. Was he on shrooms or just had them in his possession? Why would he be charged with a DUI if it was just possession? Depending on where he was and the specific laws, its possible he can plead out to a PBJ of some sort and then get it expunged. Your friend needs to talk to a LAWYER, not HR. Wtf is HR gonna do here, exactly? They arent qualified for this shit. If you can get it expunged, it doesn't show up on a background check unless you are trying to apply for a federal or public security job
It may affect your ability to travel
Hire a lawyer and try and if possible try and ensure to not get convicted. It will not show at all if he is arrested but it may appear on background checks if he is convicted but it will typically not show what he is convicted of. If it does appear, a job has to prove that the conviction is relevant for the job. It is surprisingly hard to "fail" a background test. If the company does come back and say he failed he will have an opportunity to dispute with a lawyer because it won't be clear what he was convicted for.
That what he tries to do right now. I assumed the same. As long as it’s not a sexual assault/murder/theft it can’t be really related to the job.
Your reply is misleading. Even arrest can show up, but once you get through the preliminary hearing, it will show up for sure. Second, how it won't be clear what is it for when the judgements are public in almost all states.

Background check companies usually only run checks for counties that you’ve lived in. Getting a charge in Nevada isn’t likely to be a problem for someone living in California, unless it’s a felony.
He obviously makes very poor decisions and exercises poor judgement. He should plan on a career in trash management when he is released from prison.
He should disclose it before the background check is run. If something pops up on background check that he didn’t disclose, its much worse. We are way more likely to overlook something if someone was upfront.
I'm in HR. The DUI and shrooms possession conviction would be flagged and brought to my attention. This would not stop me from hiring a software engineer. The shrooms possession would not be a big deal. The DUI would not be something that would make me recommend not hiring UNLESS the person had more than one. Then it would indicate a potential substance abuse problem and/or very bad judgement. For one DUI, I would make a mental note to watch the person. The older the conviction, the less weight I would give it. I am speaking for normal cool tech companies, not places like banks or IT/Engineering departments inside of traditional companies, where they might be more wound up.
