My new employer is in the process of filing my H1B transfer (outsourced to E&Y in Vancouver). They screwed up the LCA filing so I'm worried about getting RFE-d. Anything I should/can be doing to maximize my chances of a successful filing? (FWIW the role is UX Designer - most posts here are for engineering roles, so if anyone has encountered a RFE for a design role, would love to hear about your experience) Update: my petition was filed on the 24th July and I just received approval. Yes, premium processing is still available for transfers!
E&Y in Vancouver sucks big time. They fucked up my application as well. 1st they sent it to wrong address and then they forgot to check a box on the application. The whole thing cost me almost a month of delay and massive stress.
Unless you are an experienced immigration attorney there's nothing you can do, H-1B are filled and maintained by employer and their lawyers. Just relax and have a plan B in case things get screwed up.
OP have you heard back from the attorney? I’m a UX designer and I’m waiting for my H1B transfer results. It was filed 12 days ago and I haven’t heard anything.
Just did! My petition was filed at the California service centre on the 24th July and I received approval on the 1st, a total of 7 days. My lawyers didn't receive notice of receipt until the approval notice, so that might be why you haven't heard either.
How did they screw up the LCA?
I'm not entirely sure. My own immigration lawyer advised that it usually takes 7-10 days, so when I didn't hear back from them after 3 weeks I requested for a phone call with the immigration attorney. She replied a week later saying "there was an issue with the LCA posting and it was not properly submitted ... We expect the LCA to be certified early next week."
Who’s the immigration attorney? Is it Fragomen?
