Aspergers/Autism Spectrum Disorder in the workplace

I'm dealing with a workplace issue in Tech in regards to having Aspergers. What's the best course of action to take if you received any disciplinary action and an employer won't remove a write-up from your HR file?

    Did you request an accommodation due to a disability ahead of time? If not, you should talk to a lawyer.

      I didn't. I was told by a recruiter that it wasn't necessary to disclose it when I first applied to my job.

      The recruiter was correct, you don’t have to disclose when you apply. However, you should have disclosed after you started if you are now going to claim that you have a condition that affects your ability to perform your job duties.

      You should talk to a lawyer, getting advice from me or other anonymous people is silly. I could be giving you completely wrong information (I’m telling you what I know from experience, but I could be dead wrong).

      Look up your company’s disability accommodation policy and Talk to HR. You are protected under the ADA.

    You probably need to go into detail on the infraction and the disciplinary action, but I suspect you specifically don’t want to do that for reasons of anonymity.

    In that case, I can only think to suggest that you talk to a workplace lawyer. They will be both better informed on the relevant issues, and perfectly safe to tell everything to.
