Better to quit or resign

Hi, My gf is having issues with her company. It’s one of the most toxic workplace I’ve seen. They screwed up her h1b rfe application deadline, meaning it will now get rejected. They are asking her to take only 2 weeks PTO for our marriage. Saying if you take a day more we’ll fire you. (I mean who says that.) The manager is encouraging her to resign. Giving her advice to quit. He also put her on performance review. All this started after requesting for a PTO. It seems like they’re trying to get rid off her. It sucks, this was her first job, getting such a shitty company. She’s in depression, crying almost every time we talk about this. Any suggestions as to, if resigning is better or them firing her and how does it affect her future prospects. This is in Pittsburgh, PA.

She should find a new job quickly and leave if possible, no point being unhappy. I’m sure she’ll find something new. Please tell her to steer clear of depression because of this... it’s not worth it. Best of luck!!

She is looking for new jobs. But it’s kinda the last few months of the year ( a difficult time to get a job) Also, being on visa puts a lot of restrictions on a jump. Mainly, question is: which is more beneficial, resigning or being fired. Coz being fired seems inevitable based on their behaviour.

I wud say its easier to get hired at this time since most openings would be frozen up if not hired so companies look to fill it up

Point is too many things at play. We’re getting married in India in December. She’s on visa so the clock starts ticking once she quits (60 days to find a job) This is the last few months of the year, so hiring is usually slower.

Not really, I started looking at this time of the year few years back, got offers around thanksgiving. All the big companies was hiring. She can start talking with some recruiters about timeline headcount etc

If she waits and lets them fire her, she may get a severance package. But it’s not worth it if she’s completely miserable - she should probably just leave.

If your gf has the proofs about firing her if she takes more than 2 weeks pto, consult an attorney. Employers are not supposed to threater employs like this

The conversation went like this: Him: If you say you’ll take 2 weeks (he had said verbally that 4 weeks was ok earlier) and take even a day more, we’ll fire you. If you’re stuck in immigration, we won’t care and we won’t help you, we’ll still fire you. Her: That’s alright. Him: No, don’t be nice, this is not alright. You should say it sucks, I think you should resign and go and enjoy your wedding. How can one prove a conversation happened?

Go to HR and document that conversation. Make their life impossible. Seek advice from an employment attorney. The company will get scared and she'll likely get her way. These companies are deathly afraid of bad publicity! Truly! I've seen exact cases where it was elevated with HR and the employee got what they wanted..even a promotion to VP! HR could fix the Visa app and work around this manager see douche.

It seems they are not going to fire her until after the vacation. So don't resign. She should go until they fire or she finds a new job.

Get evidence on paper. Send out email summary to her manager of what was communicated verbally.

Needs to stay on the job for as long as possible due to visa issues. Should not quit, instead force them to fire if they don’t want her. As others said try to document everything by putting things on email. File complaint with HR to force them to treat her better. All of the above are supposed to buy her time till she can find another job.
