I am on H1B, leaving FB soon.
Can I take 3 weeks of gap between leaving FB and joining the next gig ? Will that cause any issue in the long term ?

What’s the point of making all that high tc if you are not willing to spend a few bucks and ask a lawyer?

You think blind population know this answer for certain? You wanna bet your career on that?

Max it’s gonna cost $200 bucks. But the peace of mind you will get will be priceless.

Actually lawyers opinion is really subjective, and not every lawyer would know such subtle details.

But this is something 75% of Blinders would have researched and had personal experience with.
So I don’t think it’s necessarily a bad idea to check here

Really? You don’t trust a pro who helps day in day out such cases, read other case histories, have a professional degree on it. But you would trust a few random strangers on the internet?

It’s like saying I don’t wanna go to a software engineer to track or fix a bug. I would ask a few local grocers who happens to have a computer at home.

Or don’t go to a cancer doctor but ask a few cancer patients.

Because what your lawyer tells you may contradict what another lawyer feels about the issue. Plus the question is very specific and personal experience helps.

      Your analogies are way off.

+1 boringdude. It's more like asking a question on stackoverflow where random users with experience will chime in, VS paying $200 for a "consultation" with BSing engineer who will just tell you his opinion prefaced by "generally" and "it should".

Also takes a lot more to be a doc than an engineer which takes a lot more than a lawyer.
Skill needed to be doc > engineer > lawyer.

I asked the attorney when I changed companies...here is what she said....

" it should be no problem if you take 7-10days off between H1B employers. We recommend that this gap not exceed 2 weeks. If you intend to travel international during that time, please notify us"

    Hope this helps.

No-status time? The moment you quit the job, you end the H1 visa to work for the current employer. You don’t have a status until your H1 is activated at the next employer. H1 status and working for the sponsored employer are the only legal reason for your stay in the US.

But there’s a 60 day grace period. What’s the point if it can’t be used ?

You can take three weeks. No risk. You are following the rules.

Is that 60-day grace period really a thing? I thought it was just saying.

It might be granted due to lay-off or unforeseen reasons, but resignation is a personal choice. 60 grace day period can also be shortened due to I-94 expiration date. I could be wrong.

I wont lie and spoil my reputation. I dont see any issue in 1 week off. Buy if break in more than 15 days while buying house your banker may ask reason of break between the emplymeny. U can always ask/talk to the attorney doing your h1 transfer.

Could you clarify please why it’ll be risky? Aren’t we allowed 60 days of grace period ?

Taking PTO just before leaving will make me look bad, plus the PSC is starting in 2 weeks, I really want to avoid going through that as I didn’t do much this half.

Also, taking PTO after leaving FB will make my mind completely free,
