3-4 year experienced software engineer. Sick of green card wait, like most. Indian citizen. Is it worth to apply for FANG, tier 1 or 2 software companies in canada? Aim is to stay and work there for 3 years and be eligible to apply for citizenship. Their immigration website says criteria to apply for citizenship is - to be on valid PR - stay for 3 years Anyone has experience doing such a thing? How has it worked out? TC - 170k
You do understand that if you have ever filed for an i140 petition, you can be denied entry to US as you have shown immigration intent. (True for F1, TN, Visitor visa)
Not true. I-485 yes but not I-140 or I-130 alone. And I disagree with the assessment of automatic denial. Times change. You could say you wanted to immigrate then but you found a job in Canada you liked and you bought a house, etc there and have no intention of moving back. Also Canadian citizens don’t need a formal visitor visa.
Citizens yes, PRs need a visitor visa. If you are travelling for business meetings and stuff. It will take 5 years to get citizenship + passport Also lets not say what we can argue, USCIS and DHS are not very reliable, it will be very difficult to argue your case if they decide to deny you entry to USA because you had an approved immigration petition on your behalf. I485 is just adjusting status. I140 shows yout intent to immigrate. Doesnt matter if your circumstance change in future, for US you will always be a potential immigrant. Also an entry denial to USA can cause problems in future as well.

I-140 is not enough to be disqualified. There is legal precedent on this. Only I-485 shows immigrant intent.
If you have filed I-140, you don’t need to come back on TN anyway. Once I-140 approved, you can always come back on previously held H-1B without going through lottery again
Almost 5 years for citizenship now. Rules have changed. Check out the immigration website. As an Indian your best bet is greater Toronto area. Weather sucks ass. Housing cost is insane. Free health care. And almost crime free ecosystem.
