Car rear bumper got ripped in car wash. Car wash claiming not at fault. Options?

This happened in Redmond, WA. The automated car wash essentially almost ripped my rear bumper. They claim they are not at fault since there was prior damage already present. What are my legal options? I have already filed a claim with my insurance.

Edit: I have no idea what happened while in the car wash. The rear bumper was pulled from the passenger side and there is a tear on it since rest of the bumper stayed on. That's the reason I say almost. This happened in brown bear car wash.

    Many will have a sign saying they are not responsible for damage, but if negligence can be proven you may still be able to get damage paid.

    The car wash is NOT at fault, they normally have signage with that message on it. This needs to go through your insurance.

      The place bursting into flames is not the same as something damaged as a result of washing the car.

      It matters, and you will lose the case. It’s the chance you take when you use an automated wash.

      You don’t understand negligence. Ok let me give you an easier example.

      Car wash looks fine, sign posted looks good. You go in to wash your car and the air dryer thing on the ceiling crashes down on the hood of your car and you get cuts all on your face. You contact your lawyer and after an investigation it’s found that the REQUIRED quarterly maintenance on the air dryer has not been done in 3 years resulting in rust which caused the collapse.

      It doesn’t matter there was a sign, this is direct negligence in maintaining a business. This is a sue-able offense, since the businesses actions directly caused harm to the car and/or person.

      The scenario does indeed matter when you’re comparing fires and roof collapse to your own faulty equipment that came off when you took a reasonable risk to put your car through that machine.

    Rear bumper has some scratches did you bumped it while making reverse or something? It may be that it had some sharp opening due to that incident which car wash rotators/belts got caught into.

    Unless you have a police report at the time of incident, it’s most likely on you and comprehensive insurance.
