I have filed for adjustment of status (EB-2) and it turned out there is an issue with a discrepancy between my legal entity and the one in my I-485. It has been partially corrected now (I switched to the correct entity) but some discrepancy remains. I would like to talk to someone in Tax or Payroll who can explain to me how changes in legal entity would affect my W-2 and tax records since I might need to change my legal entity with a past effective date. Does anyone know who I should contact regarding this? P.s. my attorney said that this issue is unlikely to affect my I-485 application but I just want to do as much as possible to fix it
My PERM and I-485 were filed under one entity but I was under a different legal entity. I have now switched to the same entity as what is in my I-485. But technically my past employment history in my PERM and I-485 is wrong.
If you actually were reporting to the same manager the whole time doing the same job my guess is they won't care. I brought forms to my AOS interview updating my legal entity and the officer just said "is it still Amazon? Then don't bother giving me that." So they might just not care about these technicalities so long as you're basically doing the same job. But file and bring the correct papers.
What about backdating the legal entity though? Who can I talk to regarding that? My situation is different from the usual one - usually someone is in the correct entity for which their GC was filed and then moves to a different one, whereas for me, my GC was filed for an entity in which I never worked until a couple of weeks ago when I noticed this and had my entity corrected to be the same as in my GC application
Likely zero impact. Worst case you end up having to pay the social security taxes twice on your paycheck, and at the end of the year you get back the extra when you file your taxes. Deductions on payroll aren't your final amount owing and don't need to be 100 percent accurate. The goal is just to be somewhat close so that there isn't a big amount to be paid at the end of the year when for file. At any "error" just gets fixed up by a payment or refund when you file.
What if some tax or immigration records remain with my original legal entity even after it’s corrected with a past effective date? Could that be a problem later? Does backdating of a change in legal entity have any risks?
Why do you need to backdate? My legal entity changed during i485 processing, just filed an update. It's not a problem so I don't know why anything needs back date. You so need to file paperwork about it but it's not a big deal.
