Does US citizenship give you an advantage being hired or converted? $100 bet. Don't be bias please

Friend and I had an argument about being hired or being a contractor converting to a FTE has some advantage for people with US citizenship. She is on h1b but I'm us citizen and she feels I don't really understand non US citizen's disadvantage. She has been offered a contract position or FTE at another. Contract position is more known company which I told her to join but she is keep saying it's impossible to convert over US citizen at same position. I feel work focus and competence would be bigger advantage but she feels US citizenship has bigger advantage than competence.... Is this true?

It's a clear advantage, as these days work authorization is the first question recruiters ask and many positions are automatically closed if you don't have one or are towards end of your current one. Of course op is on H1 too :) but that's besides the point.

Indeed. Most smaller and medium companies won't even consider taking on someone that requires some form of sponsorship. You have to be exceptional for those guys to go through all the work to get that set up. Once they do have it, they still initially lose money on the hire since they have to put money out to do the visa processing.

Being a US citizen is better for actual software dev work at good companies. For low-level "IT" type stuff, it's arguably worse for US citizens.

A lot of big companies don’t consider it a disadvantage as they continuously make offers to people on H1B and are well aware of the process and have legal teams to tackle that. That being said, as someone on H1B, it feels very restrictive coz you are forced to do some jobs over some you would really like. Consider the following scenarios #1 : you are really interested in working for a start up, but they don’t have funding for sponsorship or even if they do, the chances of approval are very slim so you wouldn’t take the chance #2 : if you are out of job, you basically have 60 days to find one or you are out of country. You end up accepting the first crappy offer that comes your way. With all the uncertainty around Immigration with the current administration, a lot of companies, including the one I work for, stopped sponsoring visas. So yeah there is definitely a downside to being on H1.

Yeah! And about your friends situation, it makes more sense for her to go for the full time position because of the point# 2 I mentioned above. She needs to maintain a full time position to keep her visa status.

Shouldn’t it be harder if you are on H1B? Purpose of H1B is to complement US workforce without displacing citizen employees or reducing wages.

US citizens should have an advantage. We should be hiring US first and only relying on the visa program to fill gaps in the workforce.

Yes, it gives you an advantage. I’m a hiring manager and i would always opt for a US citizen or GC holder over a visa holder. The visa transfer process adds delay and uncertainty into the process that you really only want to deal with if you have to.

Legally, I think you are suppose to. That’s the whole point of an LCA before the H1B application. You need to show you couldn’t find a US citizen or Green card holder and had to resort to hiring a foreign worker. The rules are not designed to favor H1B.

Depends on the specific language of your bet. It's illegal to discriminate against non-citizens who don't require visa sponsorship. https://www.justice.gov/crt/types-discrimination However, it is legal to discriminate against someone who would require visa sponsorship in order to work in the US, and it does usually offer an advantage if you already have a right to work here.
