Imagine that you run Twitch. You build a software platform that gamers use to stream their games. Those gamers make money on your platform. Therefore...those gamers are employees? Or you make money building a following on YouTube’s platform. You should now be an employee of YouTube? Or you sell goods on Ebay or Amazon’s platform. Should you be considered an employee? Uber builds software that facilitates transactions between two independent parties - just like the other companies listed above. The driver has no obligation to drive, just as the gamer has no obligation to stream. Both do so at will and on demand.
It's a bs analogy. Uber sets prices for the services do the drivers are employees. This will be settled in courts and not by some random analogy
IMO the issue of Uber/Lyft is that driving is actually a relatively risky activity compared to streaming on twitch or youtube. The accidental cost (e.g. crashing) caused by driving for uber had to be paid by some one. If uber doesn't pay, then it's the society paying it.
Its kind of grey area. If drivers are truly independent then uber should let drivers to set their own rate and riders then can decide which driver to pick.
That would be even worse. You’d have drivers race to the bottom making Uber even cheaper killing the company.
It would be worse, and I'm surprised Ü did not set that up. Drivers could choose to agree to algorithms that would follow prices and bid "competitively", but that would have been a better fiction than, "fuck you; that's why"
