EB3 Filing

My i140 was filed recently under EB3 despite the lawyer initially telling me that it was EB2. I am an L5 financial analyst with a master's degree and 3 YOE. I am not from India or China so the priority date is current. Is it worth it to restart the process under EB2 or let it go under EB3? How long will the whole process take? Thanks.

If the priority date is current what difference will EB3 or EB2 make? If it already started let it be.

No only thing that matters is the priority date

If it’s current in fact I’d be better to have lower level. Lower risk of objection on the position actually qualifying for EB2 level.

Thanks guys. Thats helpful. So what's the difference really between EB2 and EB3 if you're not from one of the backlogged countries? Does an an advanced degree not help fasten the process? Isn't every other country current when it comes to priority date?

EB3 didn’t use to have zero backlog

Yes in fact in 2014 there was backlog of 1-2 years for EB3 ROW. Who knows it could retrogress...

My EB3 was approved in 7 months. You’ll be fine.

Yes. 7 months. This year.
