So many people, including myself, have OPT expiration dates in May, June etc. What are the options if we don’t know the application status before our OPT end date? Eager to know from others who were in this situation last year.
What’s your company’s immigration team saying? It’s their job to advise you guys.
Probably need to go back . Had a friend do so
Cap gap will be there until you receive a decision .
You’d know in May if you got selected. After multiple scenarios. S1 you did not - you need to stop working on last day of opt. Leave country 60d after s2. Selected thus you are on cap gap till oct 1 a. Approval for both H1b and status adjustment - you are good. Automaticity changed on oct 1 b. Denial before oct 1 but after opt. Stop working immediately c. No decision by oct1. You are out of status. Stop working. D. Approved for H1b but not for adjustment of status. Stop working. Go back home to obtain H1b though consular processing. Return after oct 1.
Excuse me for sounding like a complete noob. But, premium processing only affects the approved/denied decision timeline is it? Will I get the receipt notice in time? And cap gap is only if you get a receipt correct?
My F1 opt expires in may. Assuming i get selected in H1B lottery this year, i will get CAP gap extenstion till october 1st. For consular processing do i need to travel to my home country to get stamping on October 1st? Or i can still stay and work in USA and get stamping done later?
For consular processing, you need to get it stamped by Oct
There are 2 things. If you are consular processing (not applied for adjustment of status) need to do it before you can legally work past oct1. If you mean just a visa only (not status) - any time. Ie my status got adjusted Oct 4 but I did not get a visa till December when I went to visit my fam
Go back to home country
Sure spend money on Tuition , work your ass of , graduate from a masters / PhD degree and then you should go and contribute to some other country ... makes sense I guess
@hmm Oracle, I am frustrated with the lottery process too. But getting good education( MBA in my case) was my need. That does not make us entitled to the right to stay in this country I guess

If you get selected in lottery then cap gap will save you from going out of status
