I am currently on L1 visa since 2015. My wife used to work on L2 EAD until October 2016. She switched to F1 visa staring Jan 2017 and still in college. Can I still file taxes using “Married filing jointly” status? She has a SSN and does not have any income for 2017. I am sure a lot of people would have been in same situation so looking for guidance.
Yes
Related q - I’m on h1 and wife’s on f1. I remember that I could get most of the tax I paid when I was on an F1 as a refund, does this still apply if she’s working on the f1 as well?
Wow most sensible question i ever read
Yea we just did it last year.
Yes and it should be married filing jointly. If you file as single or head of household you will end up paying more taxes. In this case you will provide one W2 and your wife had zero income.
