The firm applies for and receives many more H-1B visas than it needs, gaming the lottery-based system to snatch up as many of the hard-to-obtain visas as possible, according to the lawsuit by Gregory Handloser, a salesman who alleges HCL denied him employment five times because it favors Indians and other South Asians.

“For example, HCL is consistently one of the top-10 H-1B visa recipients in the U.S., and from 2015 to 2017, HCL received 10,432 new H-1B visas and 310 L-1 visas, far more positions than could actually exist given that HCL only employs approximately 12,000 individuals in the United States.

“All, or substantially all, of the individuals for whom HCL secures visas are South Asian.

    They make life hard for everyone. Should ban them for like 10 years. All deserving candidates would get H1B rather than those idiot bums in those companies.

      They can even fix it now, it’s just the companies who outsource for cheap rates are the bigger problem here and these consulting firms are making use of those.

      First should be rejection for all the non deserving individuals from these companies then the rules can be fixed ... I see many of my deserving colleagues and friends not getting h1b after their PhD research .... have a long wait if green cards , whereas people show fake manager profiles get h1b and green card on l1

    Visa is multi layer system in which corporate America plays a part as well. Ban H1 B completely if USA is bitten by Patriotism bug and see how it works, blaming/banning outsourcing companies won't solve the problem completely.

      Bring the salaries up to par with even 50% of FANG TCs and see what happens with those contracts. It's about cheaper workers who can be pushed to work harder. Nothing to do with patriotism, just bonuses and bottom lines.

      Actually may not be at par, but the billing rate can be quite high. But I get your point, through various layers eventually what the employee gets in hand may be close to minimum wage on H1B. It’s cheaper from employee perspective but not from the company outsourcing the job.

      H1B also get employed directly, don't they? How many get stuck with bad jobs and can't leave, thus vulnerable to exploitation. Do you think management isn't aware of these cases?

      Yeah they do, and many are exploited because they don’t know better or are subpar engineers who can’t get a job elsewhere. I’ve heard of few talks of management saying make them work they are on a visa from friends at other companies. You can still leave when on H1B, the problem is many can’t clear interviews and are stuck at the same place

    They prefer hire people who could be pushed harder and cannot walkout. Those who turn a blind eye and let people get exploited to deliver more to them for cheap, are equally complicit. It's a business strategy for many companies, that contract these companies, and that is where the fingers should point too.
