H-1B transfer denied. What to do now.

I recently got an offer from a mid size software company and I accepted it. Then they filed for my H-1b transfer and I got an RFE. I haven't quit my amazon job yet.
They responded to the RFE and I got a denial notice today.
What are my options now. Can I still work at Amazon or I'll have to leave?

Update: Position was program manager for a sw product in Seattle itself. Wage level 3. Reason for denial
. Speciality occupation. Not having a management UG or management Masters. I've done BS CS MS analytics from top 5 school.
Just a weird feeling. I do realize H-1B program has loopholes that employers exploit to underpay employees and needs reform. But this was needless.
As a silver lining for this shitty day, I got BTC and LTC on the dip. :)

Interesting. Thank god you hadn’t joined on receipt. I heard you can appeal still

Unfortunately, the appeal process is cumbersome and requires a really good attorney. USCIS is weeding out all the mediocre attorneys out there

curious if it was the transition or the PM role itself that was the cause for rejection.

Probably there are no shortage of US citizens when it comes to product management role that you applied for. If you have no product management experience, then how would anybody be able to justify that you should be hired over others who already have that experience and are citizens or lpr of USA. These are just speculations.

For h1b, you don't need to prove that US citizens don't exist for that job. All you need to prove is that your job needs a bachelor's degree in a specific speciality. This is easier to do for tech/engineering roles compared to others like analyst roles. I am not sure where the PM role falls under

You did the right thing by waiting until you had the approval notice. Had you quit AMZN, you'd be screwed. Your I-797 for Amazon is still valid so the net effect is zero. No harm, no foul !

Have you met our new administration?! That’s why. Fuck immigrants and anyone that’s not the right shade of white. That’s why.

Because there is nothing called a transfer. The new company applies for a brand new position and it is a distinct petition which can be approved/denied on its merits.

Just that now, by law the scrutiny of speciality occupation has gotten tighter including for extension of existing petitions.

Yes. This administration has been increasingly adopting a deny first, explain later. Why do you think everyone got RFEs all of a sudden? Bad time to be an immigrant.

Too many people in the US tech industry have lost their jobs or had their wages and career growth depressed as a direct result of abuses in the H1B program for me to give a shit about a questionable rejection here and there.

Don't lie about getting killed as a Uighur Muslim. You guys use these tactics to get asylum. China is free for all but isn't tolerant of separatist bullshit some Uighurs are doing. You guys travel to China every summer to visit and then claim that they are killing your people. Makes a good story to get asylum. How about wait in line as everyone else in the EB category?

I'm also HW technical program manager but my role involved design and architecture as well. I guess it all depends on the explanation of the duties in the H1B application. Make sure your lawyer gets the right details from the hiring manager. Don't just wore some random lines.

If tech companies want these types of rejections to stop, then they need to pressure congress to completely overhaul the H1B program.... And just just say "we need more H1Bs".

The entire system needs to be reformed to get rid of the rampant abuse. Until Congress gets their shit together and does something this type of thing will continue, and SHOULD continue as a way of sending a message.

Did you provide USCIS in your RFE response with a proof of management subjects taken in your masters program ? Since this is a program manager role.

That's so bad. Why does anybody need a management degree to be a Program Manager. Did you get a RFE and then reply/follow up?

I'm also going from being a HW engineer to a program manager.

Damn. H1b transfer is the solution to preventing employers from exploiting loopholes and underpaying. Denying an h1b transfer makes things worse by limiting market forces on the process.
