Hi All, My H1-B visa is expiring in November month. My company said they will apply in May. I was asked about premium processing. Should I go for premium one ? I heard somewhere - these days you get RFE if you go for premium processing as DHS has lot of backlog. What are your thoughts?
It’s better to get it done in PP if you have that choice. I think there is no relation between RFE and PP. If they file it right with all the required documents then you should be good. If your Bachelors and Masters can justify the work you are doing currently then you shouldn’t be worried. For example if you have done your Bachelors in ECE/EEE and working in IT then they will have to provide additional documentation to justify how your Bachelors is helping you perform your Job.

If your company is paying for premium processing, it’s better to go for it because USCIS expedites adjudication of your case. However, if USCIS finds that the documentation submitted for your H1b petition is not sufficient, Petitioner (your employer) may receive a RFE notice as a result of adopting the premium processing service within 15 days of filing H1b petition for extension.
Even with RFE premium is better, you get answer either way in 15 days from filing petition or rfe response. If company is paying for it then get it done... why would you even think? By now lawyers have figured the new normal for changes in extension rules... so they prepare application well enough to avoid RFE...
