Hi Community! My current H1B is expiring in July 2018 (started in October 2016). My current employer is filing for an extension. However, I'm planning to switch my employers at the end of April or start of May and my new employer is applying for my H1b transfer. I searched online but most of the posts I found are outdated (2012ish). I have couple of questions here- 1. Can my new employer apply for an extension after my transfer is approved? 2. Is there any time window that the transfer and extension should be completed by? Really appreciate the help. Thanks!
If you haven’t run out of 6 years of H1, you’ll get up to 3 years on your new H1B.
No, I still have around 4.7 years left.
My situation was worse than urs... My previous H1 expired Dec 31,2017 and extension applied on Nov 3... Transferred my visa to new employer on Feb through premium... got approved for an year... Still didnt got any result on extension yet... So, what exactly you are worried about?
I’m in a similar boat. Are you saying you can have a new company file for transfer after your I-94 expires and you’re in the 240-day window?
Yes...
same here.. my previous employer applied for extension.. moved to a new company after 5 months and my previous company had to cancel the extension since they never heard back from uscis

1. Yes, the new employer will file extension for you as long as your PD is not current. 2. See #1: PD is the key.
Transfer petition should extend your date automatically based on docs submitted by new employer. If not, your new employer will file the extension but do take the concurrence hoping they are not hiring you for couple months only ;)
Something is not clear. Why do you think the new employer has to apply for extension after transfer? You may get transfer itself upto 3 years because you still have 3 more years on your H1B
Oh gotcha. This makes sense. My current H1b expires in July. What I understand is when my new employer files for transfer, it will get potentially approved for 3 years. Initially, I was under the impression that my current H1b would get transferred to my new employer with the same expiration date (July) and then my new employer has to file for an extension.
Has anyone got their stamping done after their H1-B extension and transfer were approved but their I-94/H1-B was expired? M y H1-B transfer and extension were approved while I was in 120 days period after my I-94/H1-B(first 3 years term) expiration. I am planning to get my visa stamped and was wondering If I need to go through the interview process or I am eligible for drop-box. Thanks.
