H1 Transfer

Currently I have got RFE for my h1 transfer in premium. If I respond after sep 11 will I be eligible for premium H1 Transfer or it will be considered as regular.

I am in the same boat. From what the USCIS ruling says, it looks like applications will still be considered premium. Ruling reads: We will continue premium processing of Form I-129 H-1B petitions that are not currently suspended if the petitioner properly filed an associated Form I-907 before Sept. 11, 2018. Therefore, we will refund the premium processing fee if: 1. The petitioner filed the Form I-907 for an H-1B petition before Sept. 11, 2018; and 2. We did not take adjudicative action on the case within the 15-calendar-day processing period. Getting an RFE technically means adjudicative action has been taken, so I think premium should still hold for these applications

I'm in the same boat. My attorney said USCIS should honor 15 day PP. However, if you read their statement above, it says we will refund the PP fee if we did not take action within 15 day processing period. It is confusing. I guess we just have to wait and watch.
