What are major reasons for H1B transfer to be denied or get an RFE.
Just adding a stats from my previous poll with over 200 responses - 50% of the filled cases either got RFE or denial.
Wht were the reasons
Oouch! I assumed it probably 5% RFE and <1% denial
If joining a consulting firm. Be prepared. My very close friend got rejected twice for renewal and now has to leave
Deloitte?
Yes
I wanted to know the rfe or denial reasons for H1 transfer only.. not for renewal or extensions
One I know of is your role/responsibilities not reflecting the needs of specialized skills ..my friend is a program manager and his h1 transfer got a rfe citing lack of specialized skillsets
If you don't mind sharing, which company did he receive this for? Also, bachelors or Masters degree info would be useful.
It’s usually the “speciality occupation” RFE. Employer needs to show why the job requires someone with bachelor or masters degree. You could just google to find more information. Here’s one link: https://www.calivisa.com/immigration-law-blog/uscis-h1b-specialty-occupation-visa-wage-level-rfes
Few reasons could be degree and role not matching, pay is less (happens if you are joining consulting firm)
Some RFEs are just utter BS for lame reasons. Mine was extension n they wanted payslips from time application was filed to when it was received by USCIS..
Bit tricky ?
Well, actually quite risky!
What if I file for transfer on day 1 of my h1b with no payslips ? Will I get a rfe ?
If your lawyer is good then they will suggest to wait till you get one or two pay stubs before you start the transfer
