H1B RFE denied. What are my options?

Got status update on USCIS website that H1B has been denied after I responded to RFE. Issue is that I have a PhD in mechanical engineering and I am working as a software engineer. My PhD was focused on computational techniques and I took a ton of CS courses that enable me to be an SDE but USCIS doesn’t think so (which I feel is ridiculous) and denied my visa. I have two more years on OPT. I am wondering if I should try for H1B two more times or go with a postdoc (I currently have a postdoc offer and I have two months to decide). What is the likelihood of H1B being denied (assuming it is picked in lottery) given that it was denied once? I am quite frustrated with this visa business and I would like to avoid academia so any tips are appreciated. One option is to return to my home country but jobs are hard to get in software engineering without a CS degree and my PhD was in a very niche area so jobs in mech will be hard to get as well.

    Take postdoc, get GC through EB1. Join Apple for 5 years. Get citizenship. Join USCIS. Pee on your case assignee. Establish dominance.

      So what you could do is file with Apple ASAP for eb2/usual, leave for post doc once i140. Have productive post doc then port the Eb2 date with your eb1 petition? Or move to Canada (my plan)

    Why not contribute to progress in India. Obviously you are intelligent with a PhD. Why not join ISRO and help them with a successful Chandrayan2 second attempt? Why waste your life struggling with visa issues? It's only intelligent people like you who can make India a tech giant.

    For comparison, a majority of good Chinese PhDs return to China to start their own research and build Chinese tech scene.

      Lmao. Systemic change occurs not from scientists going against the system but by policy makers actively changing it. Now don’t tell me to study to become a policy maker 🤷‍♂️

      Also, are those Chinese students returning out of will or because they couldn’t get a job here?

      What "against the system"? There are scientists and engineers working at ISRO.

      Chinese scientists make China a better place for R&D, which in turn draws more Chinese scientists. Results get more results and money, which in turn gets more money and results.

      This is garbage every Chinese person I have met in academia and tech in the USA has wanted nothing more than to live permanently in the USA. The ones who return are those without a choice or who are independently wealthy and connected back home, same as with India

  • Re-file a new case with strong documents. Find some external authorized institution (like EC2) who can confirm and certify that you have strong CS background and with your workex, you are as good as a computer science bachelor/master professional. You should then be good.

      Yep every single one of the jobs I applied to said they wanted to take CS degree folks and that too new grads. I am way overqualified at this point
