Current startup is running out of cash and has - paid me less than the salary in the H1B - not paid me this reduced salary for the last 2 months I understand this makes me out of status and invalidates the visa. I should have done this earlier but what are my options for transferring without paystubs? Any other way to prove I was working? I’ve heard recently H1B transfers are being rejected without RFE so specially looking for recent cases where this happened. Options I have: - Transfer to another company without paystubs and risk rejection. In which case I might get deported. - Wait until startup can pay and transfer with paystubs. This might never happen. - Complain to department of labor and use complaint in H1B transfer. This will likely kill the startup. I will consult with immigration lawyer but asking here to find similar cases in Trump’s America. Thanks! TC: not being paid
Damn, if the company has not paid you salary for 2 months , why the hell are you with the company then ? The first paystub you missed you should have looked around for a job. What you can do is upfront tell the startup that you are going to complain to DOL, better threaten them with a lawyer. Ask them to start paying for 1-2 months. Look around for a job
Thanks for your reply. I was unaware I would be out of status and believed CEO’s promised that we were so close to getting paid... Looking for a lawyer right now.
You can use a lawyer , at the same time be amicable. Tell the company that it’s in the best interests of both the company and you that you are paid. Get last few paystubs for past months (at least 1-2) that will help you on job change. Keep searching for job actively in parallel
Leave the US while still considered to be in status (USCIS doesn't yet know that there is a problem) and apply for a new h1b from outside the country.
Either this or file a complain with DOL and use that for H1b transfer.
Ask your CEO to pay you on a promise that you will return the 💰 immediately.

Indian PM 2024: who gets your vote?
Can't transfer without paystubs. No lawyer will even file your transfer without them
