H1B ammendment- Switching from Dev to PM

I have received a PM2 offer in Microsoft. Currently I am a SWE and my H1B visa stamp has expired and I have an approved H1B extension letter. The immigration team mentioned that if i accept the new PM 2 offer, they will need 4 weeks to prepare and file H1B ammendment. After that if the manager approves premium processing, it will take more 15 business days to get approval. Currently, the number of RFEs has increased and the chances of visa getting denied exists. I need to travel internationallly in december which is very important. Does anyone have any recommendation of what steps i need to take now? I really want to start the new job but I am in delimma because of my Visa situation.

Hope for the best. I had an RFE from transferring an H1B from a company A to B and it delayed the approval for around 5months. That was last year at the beginning on the new system. Microsoft lawyers team is probably aware of the new RFE trend and will more likely make sure you won’t get the RFE. The sooner you trying to get to MS the sooner you’ll get a response for your visa

Thank you for your response. Did you choose Premium processing?

File without premium processing and travel. That's what I did during the past couple months while waiting for L1B-->L1A change (approved without rfe after 4 months). If it gets approved you just need to wait for the notice before you travel back.

Thank you for your suggestion. But my current h1b visa stamp has expired. If I travel outside, I wouldn’t be able to come back until the h1b amendment is approved. Am I correct?

but you have an approved extension letter, you can use that to get a new stamp. Message the lawyers and ask them what you can do, they should be able to give you a much better answer
