Hi guys, I wanted to know if it's ok to travel outside of US in May - which is after April when the employer applies for H1B and before the H1B result comes out in June! Thanks
Be 23 years old. First job. Just finished Masters at some leading US univ. Joined Microsoft last week. PM! fk yeah! MSFT will apply for H1B, want to go for cousin's wedding in India in May. Want to look good too, trying to see how to use the 800 bucks, maybe choose proclub instead. Heard about this new app called Blind during lunch. Installed it. Let's say hi with 2 questions. Amirite son?
Ask your lawyer.
Why all the heat folks! It’s a simple question anyone with pending H1B would have. Anyway, I’m no immigration attorney but I myself have researched and talked to my attorney (through Apple). I was advised against traveling until your status changes to H1B (which happens in October, if I remember correctly). Or if you do choose to travel, you won’t (take it with a grain of salt) be able to return until after your H1B visa starts (which again is October).
One of my friends from Amazon travelled to India in April after the filing. She’s didn’t have any problem coming back. However, she had to respond to a RFE because her I94 had changed because of her travel. She submitted the doc and got an approval later. So I think it should be fine.
This. Again, talk to lawyer.
Not true. Stop giving BS advise. Even after your H1 is approved, the status changes after Oct.
OP - I have been into that situation and I had no trouble coming back. That said, every case is unique and inform your immigration attorney so that incase something happens, they can help you.
It was absolutely fine earlier. With trump and anti immigrant sentiment it is better to wait till oct to travel if possible
It was fine before with travel petetion but now it is possible you will be sent back so !!
If you applied h1b with consular processing option, there is no restrictions on travelling internationally at all. Why not ask your lawyer to file with consular processing rather than change of status?
Hey thanks...have you heard Microsoft sponsoring under consular status? Are there some cons particularly in consular option vs cos that I should be aware of...
you picked the right place to ask this question! blind is actually full of immigration attorneys and lawyers, so they can help you and give you some real answers. good luck!
It may not be full of immigration lawyers but it is populated by a lot of immigrants and it is possible that someone here might have gone through a similar situation and hence might be able to answer the question.
