Here is my situation: I moved to US on L1 Visa with Company-A, after 2.5 years I switched to H1B visa and the company filed my green card application and got my I-140 approval 7 years back. During this time, I have got 3 extensions with H1B. I am no longer working for Company-A. Now through Company-B I got H1B valid for 3 more years. Company-B has not yet filed green card for me, so after 3 years when my current H1B expires, will I get another extension based on my I-140 with Company-A?
Yes that is how is works Once you have valid i140 you dont need to refile it every time Only requirement is that when your filing date becomes current for green card you need to have current i140 which is why it makes sense to file it from new company
