H1B extension in RFE requiring explanation on why BTech is necessary. Anyone came out as a winner out of this? How?

Wife's H1b extension got into RFE, USCIS is asking for justifaction on why BTech degree is required. Amazon legal team is a mess, I don't trust them, does anyone has a winning strategy to deal with this and not convert RFE into denial? Role Product Manager Technical, L5. 10 years of Exp, BTech IT from India, I140 approved already, Fragomen is representing the case, don't respond to any emails even with high priority.

It’s lot to do with the Job description where they mentioned the degree , if no degree required is mentioned then will be tough to prove for immigration team why they need a engineer for it

Sorry to say that’s a losing scenario. Btech degree is not required for technical PM role so RFE result is most likely a denial.

Can you share any data points on why do you say so? The OOH handbook lists BTech as a required degree.

Does the job description not mention that “Bachelors in Comp. Science or technical field required”? Also, who prepared the job description, duties and responsibilities - lawyers or your wife? Asking because at some companies lawyers ask managers or candidates to write the description, duties and responsibilities. Amazon has tonne of PM-T positions, I would imagine the lawyers have handled such a RFE before. Does your wife have US masters or work experience?

She has been working for 6 years in US, 5 with amazon, no masters in US, how would that have helped though? . The job duties and description was prepared by the manager, do we change it and have the lawyers prepare it now as they plan the response for the RFE?

Not sure if MS would have helped. I personally feel US MS students are given some level of preference by USCIS. I could be totally wrong and your wife’s case was just cherry picked, as someone else mentioned. Is the HM supportive? You could work with him/her for preparing a solid RFE response. Does the job description not mention that “Bachelors in Comp. Science or technical field required”?

First case I have heard in Amazon. Does your wife have Masters degree from United States? Usually PM/PM-T gets clubbed under combination of Tech (software development) and Operations (MBA/ MS Industrial Engineering role) - both can be proved speciality occupations with specific skill sets (operational experience in service industry in IT security) or Natural Language processing (Machine Learning) requiring Bachelors in computer science. I feel your wife’s case was sheer bad luck where USCIS cherry picked. Amazon, however, should secure her job and possible will move her to Luxembourg/EU/India and bring her back on L2A (L5 usually come in as L2A)
