That is a big risk, it is better to stay in old job and wait for h1b than to join with receipt
Agreed some risks... but that is a decision the candidate needs to make NOT the hiring manager(OP in this case)

Receipt of transfer application which makes him able to work at new company. It is not fool proof and application maybe rejected.

I assume you dont want to consult your own comapny’s lawyers. Its H1b transfer (not a new visa). So unless your company messes up on the application, Mostly more around your company, it’s history on such cases, the job being offered, etc. There is not much the candidate can mess up here(he already holds a valid h1b). She/he can join on transfer application receipt from uscis. Traveling out of country could be avoided while application is pending. There really is no reason for concern here.
The concern is mainly the time it takes. Attorney is giving vague answers. If it is taking 6 months to transfer these days that it is a no go sadly.
I have joined msft on the transfer receipt and approval came in 2 months later long back when during another such Uscis slowdown. 6 months is worst case. Attorney can only vague answers since no one can guarantee on govt related paperwork & timelines. I assume your company hasn’t done many visa applications. This is all regular process. Let the candidate decide if she/he wants to join on pending approval.
