Let’s say you found a new job and filed for H1B transfer to a well known tech giant in bay area. In the prevailing situation where government is toughening up the rules, would you still join the company on H1B filing receipt?

Referring to companies like Google, Facebook, Netflix, LinkedIn, Uber, Amazon, Apple, Airbnb, Twitter, Microsoft, etc

  • If it’s MSFT, I’d recommend joining with receipt. They have a team who knows shit when it comes to immigration.

    Ebay: wait for approval cause the lawyers don’t have a clue.

      I don’t think. When I mean in house, they are msft employees working for msft legal stuff and for LinkedIn we have BAL Global which is a third party company

      Microsoft uses Fragomen for immigration staff. There will be a team dedicated for each person anyway. You can reach out to them for any matter no matter where they sit. What you mean by in-house is that there will be employee lawyer representative as well who may or may not be handling immigration. That also exists in many companies like Microsoft, Facebook, don’t know about Linkedin yet.

    Msft legal team is crap. Their green card application screw up few years ago is a popular story. If you haven't heard about it, they F-ed up a batch of 100 or few hundred green card applications and the poor souls had to restart the process (losing their priority date). My personal experience with them has also been terrible.. so I'd not bet my money on them.

      I can't remember the names.
      One with Msft - terrible but proactive
      One with LinkedIn - not as proactive but very responsive and they know their $hit. Also very helpful.
      Proactive - Msft legal started my H1B immediately after I joined (I joined as a grad hire) ; kicked off GC processing immediately after;
      LinkedIn took over my H1B and completely forgot about my green card paperwork until I started the conversation.. but once I started it, it's been going good so far..

    I've heard horror stories these days where they give their notice based on receipt and getting into RFE/declines. I'd rather play it safe given Current political circumstances.

    You should join on receipt only if your employer is willing to have a backup plan if the visa transfer does not work out. By backup plan I mean moving you to a different country.
