with the new employer? Can I start right after the new employer files for H1B and before the transfer gets approved?
Your employers immigration team should be answering this question
I don’t want to start a new employment relationship by saying that I was laid off from a previous one so can’t go to the immigration teams of either companies
OK- this is how it’s going to play out. Generally you have 30/60 days before you go out of status. You also go out of status if the date on your I94 expires. When you go with the new employer they’ll ask you to send them the new pay slip when they are filing for H1Transfer. If you give a month old payslip they usually know something is up. Try to find an employer ASAP so that you are still OK with the last payslip from your ex-employer. Timing is everything.
But did Moody’s fire you?
Why under AMA ?
I got transferred to US on L1 in my current company I got H1B visa confirmed but yet to be stamped. Got laid off, my last day is another 10 days in current company. I am expecting offers from 3 companies. A. After 10 days if I don't get an offer should I change my visa status from L1 to B1 (as I already have it) B. As soon as I accept the offer from new employer is the status changed? C. Should I go back to home country and wait for new employer to confirm visa, get it stamped and reenter ??
Yes
Thanks for your response. I was trying to figure out online if the Trump-era rules have changed this.
No. But this is risky too, because your transfer may not go through. That has changed in these times. But well you don’t have another option
