H1B woes!

I am in my last 3 years of H1B and recently a recruiter from Arista Networks has reached out to me and the first question he asked was about my visa status and when I said I was on H1, he said he got instructions from his management to not to proceed with H1s coz of the current immigrations policy mess - timelines to transfer h1s have become longer and there is a very tough scrutiny on H1 applications during the extension process etc.

Facebook and survey monkey also didn’t proceed with my application after I revealed my visa status?

Has anyone here faced this kind of rejections, what is your strategy - sit tight in the current company till you get your GC?!

@New You seem to think money is the only thing that matters.

If you have dependents to take care of and you don't know if you'll be around for the next year, stability matters a lot. Germany has one of best facilities in the world. Free education, Free healthcare, awesome infrastructure. Cons are high taxes. But well worth it.

      What about social life?

What about it?Your social life is what you make of it and how open you are to integrating. It will never be as good as India but that’s a trade off you make while immigrating

Well living in silicon valley gives you as good a social life as you will have in India. For me it's very important to have my friends of many years close by.

This is illegal. Tell them you’ll sue them if they don’t proceed.

    • if ICE found out you tried to sue an American Company, you maybe BANNED or BLACKBALLeD for LIFE..... sue later when you are an American

The law is very clear about this. A person holding a legal form of work authorization in the US cannot be denied a job simply because of the type of authorization. The company can refuse to sponsor the individual but the type of work authorization that they have cannot be the reason to deny them job opportunity.

It’s not illegal. You don’t have a legal work authorization to work for a company that hasn’t sponsored your h1 yet unless you have gc or citizenship.

It's not illegal....it's known as company policy..

In the end, they are trying to run a company and not some charity

    • Its not illegal - get it inside your Indian mind, not everything is illegal and you just don’t have to feel entitled all the time!

I had lots of experiences like that. When I was in college and cleared hours of interview with Verizon and the hiring manager told me he was going to make me an offer. During the background check, HR told me they had to take back the offer because I need H1B. I told them I could work on OPT for 29 months but HR said they are looking for people who can commit to work there long term so they don't hire people who may need sponsorship in the future. FUCK Verizon! I'm glad they didn't hire me because I got much better offer later. The companies that reject you for H1B are shitty companies anyway. Fuck them all! They pay like shit and have tons of lazy Americans coasting there for 10+ yrs. You pobably won't even want to work there anyway.

Indians are anything but humble. Despite becoming American citizens they will never miss celebrating August 15 Indian Independence Day. They are also very racist. They are known to tell their kids not to bring home a BMW bride or bridegroom. BMW - Black, White, Mexican.

Strategy is to go back to home country or a better like Canada.

Stay lean in US. Don’t make any significant investments here.

Yea.. I was also told that if I have less than 24 months left on H1B/Opt at the moment they are not interviewing.. I was shocked but I guess it was org specific. This was data scientist, Integrity.

  • Why don’t you just go back to your home countries and not have to live like a second grade population? I will never let that happen to me ever.

But your ancestors also took that decision of migrating to US. Given enough circumstances you probably would too.

@Gen Patton everyone has a dream of pursuing his or her dream. Now whether it is U.S, Canada,Australia, India or some country each individual have their own reasoning.
Coming back to you suggesting to go back to home country, sure we do have that option but what have a look at the statistics below the % of immigrants working hard to ensure USA is UP and Running:

More than half (54 percent) resided in four states: California (27 percent), Texas (13 percent), New York (8 percent), and Florida (6 percent).

If every immigrant moves back to his/her home country then U.S will be completely off the list from world Map😂

I have been in this phase for the past 12 months, hiring a h1b candidate seems to be a liability...I got so pissed off that i started requesting the HR or hiring managers to provide a chance to showcase my ability.

    Best of luck anyways :)

Because they don’t have the guts to fight corruption and crime in their countries where everything is rigged against the poor

    • Then they should be somewhat humble, and thankful. Indians on H1B come across as very arrogant and has high sense if entitlement. You can feel that on blind as well.

Thanks everyone for the responses! I feel like I am not the only one! I’m definitely not going to sue any company for not proceeding with my application - it’s as good a lost opportunity for me as for them! 😊 I’d thank the recruiter for being frank and explaining the current mess. Now I realize that even if I get my I140 through Cisco, I should find ways to work here till I get my GC or as someone above suggested explore career opportunities in other countries.
