H1b VS tn

For those who have went from a tn to h1b, has it been worth it? Been selected for lottery but not sure if I should stick on tn. Been thinking of moving companies and not sure if I should wait till October to get the h1.

Also heard that people who got selected last year are just starting to get their h1bs now... So wonder if someone could also share timing of receiving visa.

    I believe you cannot apply for permanent residency with a TN visa.

      You can't apply for GC with TN since TN is not dual intent.

      If I'm telling you that you can, you can. I did. Stop arguing things you don't know.

      The thing about immigration intent is that it does invalidate your TN status, but that is only useful for traveling, you still have your i94. This means that once you start the process you're gambling that you will get your GC before your i94 expires. It also means you can't reenter the US between submitting AOS and getting the permanent residence, so no more family visits for a year or two.

      It's kindof stupid that you can apply for Perm/i140 while having a TN, for USCIS purposes you are still on the non-immigrant intent boat until AOS is submitted. But you can.

      By the way, when going this route with a TN you must also request a card called EAD+AP, employment authorization document with advance parole. This will allow you to travel and work even after i94 expires. You are also guaranteed secondary inspection when crossing the boarder so you will be sitting in a room for 1 to 3 hours doing nothing and potentially losing your flight, but hey, that's what it takes to go this route.

    Worth it, but not super important, only downside of TN is that it has more risk with the current racist administration, but if you are Canadian then there's probably nothing to worry about
