H1b transfer denied @amazon

My h1b transfer was denied. I left my previous employer 6 months ago. Manager doesn't know what to do. They terminated me now, and said it'll take 1 month to refile. My lawyer is saying it's okay to stay in country. I don't trust fragomen. What to do.

You can legally stay in the country, but you lost your status and you have 2 months of grace period. Hopefully a month later they file in pp and get an approval. Meanwhile you should probably look for other opportunities and file in parallel to increases the chances. Personal advice

Ask amazon to see if they can transfer you another country (Canada) Also ask fragomen to figures out why your case was denied ( hope they didn't screwed up the paperwork). You can always appeal your denial. Assuming yours is a legit petition ( MS in CS and software engineer as a role), there is no reason for USCIS to deny your petition. Push back on Fragomen to figure this stuff out for you. That's why all these big corporations pay tons of money to handle our immigration matters. Good luck OP! Hope this works out.

Which role are u in? What was the reason for denial? Check with Amazon if they are okay for u to work from Vancouver/India, u can later come on L1 or something

Many lawyers say it's okay to join on receipt. You have to make this decision on your own analyzing the risk involved yourself. My lawyer told me it's okay to join G on receipt and I had to tell them and the recruiter that I would only join on approval.

Check with your lawer when does your grace period started? AFAIU, it starts when your previous employer revoked your h1b. In that case 2months are already over. Good luck! Hope things workout soon. Why it took so much time for you btw with premium processing enabled?

You need to hire your own lawyer, asap! Fragomen represents Amazon's interests not yours, that's called dual representation, a letter you signed when you filed for H1. I highly recommend Pam Genise at Murthy Law. I was in a 60 day grace as well and she provided solid advice. Best couple hundred bucks spent! Prepare your questions and go to her. Please do yourself a favor and do it today. We may be helpful but I doubt any of us has a law degree and is an immigration specialist. You don't want to screw with staying beyond status expiration. Btw others advice is spot on, get another offer or transfer to another country, get that process started asap. Amazon may be great but you need a valid status and can always go back to them. You got through once, you will get through again. Good luck!

Hire external immigration attorney to discuss your situation. It’s worth to spend few hundred bucks in your situation. Don’t listen to the folks who keep saying “why you did it”. Move on from that decision - look forward. Good luck.
