My wife moved from an H4 to an H1 recently and since she hasn't traveled out of the country yet, she doesn't have an H1 visa stamp. Her most recent i94 expires next year along with the expiration of her H4 visa stamp. However, when she moved onto an H1, her i797 approval notice had an i94 extension attached at the bottom. Is this i94 extension good enough to continue staying in the country until she travels next? Or does she absolutely have to travel outside once and reenter on an H1 prior to her current i94 (issued on H4) expiring?
If I remember correctly, she is good now. But that’s an attorney question to make sure. You don’t want to play with those things based on opinions from strangers on blind
I did check with my lawyers, but they were being weirdos by not really answering the question but still suggesting that the I797 is good enough if it has an I94 extension attached
If you have access to USCIS office, make an appointment. I’ve used them many times. Very helpful. After all attorneys are second hand information and not always correct
Ultimately i94 and i797 is all that matters. She's in a legal status. If/when she travels out, she may need to get H1 stamped on her passport, though, so she can re-enter

She will need to get H1 stamp for sure when she gets out. But now she should be under the latest i-94 for the time being
