Received RFE(Specialty Occupation) when transfer H1b. I haven't leave my current company and wanted to wait until the approval rather than just receipt. My background is Bachelor in Mathematics and Economics, the LCA SOC title is Operations Research Analysts(15-203, https://www.onetonline.org/link/summary/15-2031.00 ), and the position title is Business Operations Analyst. My lawyer(Pearl Law Group) didn't ask me to provide any documents(not even course lists), she only sent the new manager to prepare some supporting files. I am worried since the denial rate is so high right now, most of the time the law firm doesn't really put enough effort on one petition. Couple friends whose H1b got denied told me the same - 'never trust lawyer 100%'. I wanted to see if anyone been through the same and what documents you prepared for RFE? Thanks in advance.
Are you joining on receipt ?
No no, the Hiring Manager agreed to wait. I am more afraid about the denial, the rate is so high. The lawyer of the company does not really respond to my emails so I'm very worried about my case.
I also got RFE with same law group. How did it go? Did you get approval after RFE?
got RFE from the same law firm.. have you received the final decision?
For a speciality occupation RFE, everything rely on your new employer. They have to defend that your job qualify for the H1B status. That said. 61% of the H1B that gets RFEed are approved as a conclusion.
Does that mean almost 40% RFE were denied? Wow that number really scared me
Yes. That’s what the H1B statistics for 2019 shows. https://www.fragomen.com/insights/alerts/employers-see-more-rfes-and-denials-uscis-data-confirm
