It's not in your hand. Your team members all need to be in eb2 category which means if your team hires a new undergrades, you are fucked.

Yes, if the team you are joining has any teammates who are undergrads with less than 5 year experience, you will only get eb3

The labor certification (PERM) is leveled at the lower level of your team members. You can't say my job needs a masters degree if you colleague does it with a bachelor

This makes no sense is every position in the team same? It definitely did not apply to my current position, we have all levels from undergraduate to PHD and eveything from eb3 to eb1.

    NVIDIA sponsors everyone, day 1.
One of the many reasons I love working for them.

EDIT: They start on day 15, aftet you've received your first paycheck.

If you're asking about Microsoft, as long as you're level 61 (first level of software engineer 2, new college grads are 59) or have a masters degree or higher

I have a masters and they started the process for me like 3 months in

3 months after you got h1b? You need to be on h1b to be sponsored for eb2 right? Or can gc be sponsored while you're on OPT?
