Also if I'm on a TN-1 Visa, is it risk-free to switch to an H1-B? Thanks!
Just apply GC. You should get it within 1.5 to 2 years if you don't get audited
What happens if you get audited? Why do they audit?
Your company needs to prove that they can't hire a US citizen as qualified as you as a first step. For this step they have to file PERM to department of labor. During this process, your application could be audited for further information. This will slow down the application. Hard to describe everything there, just Google it. :)
A marriage.
Queue length depends on your country of birth. If you are Indian or Chinese with a Canada citizenship, you are still gonna wait a few years unless you go with eb1
You get an adjustment of status - you don't need H1B. I know Canadians on the team that got their GC in 2 years from a TN
It depends on your place of birth and not citizenship. If you are born in anywhere else than India, then probably 2 years. If you're born in India, then indefinite wait.
This is true and should be else all GC will be taken by Indians only like H1 b
H1B has few categories. EB3 - longest, will take 5-6 years. EB2 (you have to meet min requirements) will take 1.5-2 years. EB1 (also has min reqs) not sure, but shorter than EB2. Whole process sucks. If you can get GC from TN, do that.
Who told you EB3 takes 5-6 years? It completely depends on where you were born. If you are not from India or China EB3 and EB2 take around 2 years
I went through it. EB2 does take 2 years, EB3 takes 5-6. Not from India or China.
It took me 9 months on EB1.
Came in on h1b from Canada. 10 years later got my GC
Why would you do that? My friends got it within a year or so
Why would I switch from TN to H1-B?
Yeah why switch?
