I-797 bottom part and copies

Hi Guys, I only have the bottom part of I-797A document(i-94 part) and a copy of the whole document. Is that sufficient for Visa stamping and port of entry. I am considering applying for the duplicate but I have heard it takes a long time. Any similar experiences?

I am also in the same boat. I have applied for duplicate. It takes 2-3 weeks to get acknowledgement. To get a duplicate copy it takes around 8-9 months according uscis. I am also thinking to go for visa stamping. For which we don’t need original i797. Copy with ack for duplicate i797 should be sufficient I think. But better check your company’s attorney and you might take second opinion from other attorneys. Don’t have much information online. It sucks to be in this situation.

Yes, it's written on the I797 that the top part is to be retained by the employer. Read ur copy

I do see that in the copy but what I read online was something different. I wasn't sure.

I showed both to visa officer, she told me only the second part is required.

Only bottom portion is sufficient for visa stamping. Yes the top portion will be retained by employer but you can always ask him for visa stamping , if they have one

H1B approval notice belong to employee and you must ask your employer if they haven’t shared it
