I switched jobs in feb 2017 and got a H1B transfer approval notice that has a I-94 valid until Feb 2020. I then took a trip back to my home country in Oct 2017, with the stamp on my passport that had a valid visa through my old employer that expires on 7th feb 2019. I did not get a new visa stamp, because the old visa was still valid. Just noticed, that on arrival to the USA in Oct 2017, the date of valid entry on my passport is set to Feb 7 2019, even though technically, I have an I-94 that valid until Feb 2020. Due to “Last action” honored rule, I think I can’t work in the USA after Feb 7 2019. Is that true? Anyone faced a similar situation before? What did you do?
If you had not changed your employer, your I 94 at the bottom of the approval notice should be sufficient . Because you did change your employer, you should get visa stamped outside US preferably at your home country .
Yes. Looks like I’ll have to go back to my home country and get a new stamp before feb 7,2019
Btw, In case any one is wondering - Just spoke to a lawyer, and the right thing to do is either : A) go to the CBP office and get them to move the “admit until date” based on the new employer’s I-797 Or B) Go back to home country and get a new stamp before Feb 7, 2019 Because of the government shutdown, option A isn’t really an option. So, Option B it is!
I got mine updated by visiting a CBP office. Basically Boston airport has a CBP office and it was done in 5 minutes. Those CBP offices are also closed because of shutdown?
There is an office in downtown SF that is closed. Haven’t checked the airport. How long did it take to get your passport back from there ? What documents did you need to carry? And where in the airport was the office ?
I went to the boston airport. As I said it took 5 minutes for them to update everything and correct the date on the passport as well.
Check uscis website I-94 date. That’s the one you should honor. Your option is to go out and get visa stamped for current employer and get in. I am sure your license will expire in feb and you can’t renew without getting new i94
Uscis latest I-94 “admit until date” is feb 7,2019
Then it is Feb 7, 2019. You will need to apply for a status extension. You may not have time for this and may need to leave the country and get a new visa stamp.
