How to save India from destruction?
So, low TC and my career has been stagnant. My PERM was approved a couple of months ago but the immigration folks at my company say that they need 4-5 months after PERM approval to start processing I140. Also, I heard that after I140 is approved you need to stay with the company for at least 180 days to safeguard your priority date (I am originally from India). Given all these parameters how does one plan a job change, I have a few recruiters contacting me for interview dates but it appears that I have to postpone these for around 7-8 months later. Has anyone been in a similar situation, any advise is appreciated. TC: 130k
You don’t have to stay with employer for 180 days if your employer is in good faith. Usually they don’t revoke it unless you provoke. Talk about this with company immigration lawyer they would let you know if current employer revokes it or no. Mostly they won’t because there’s no cost benefit to employer and they have already spent the big bucks
Can you ask this question safely without raising an alert though? Read somewhere that the information we share with immigration lawyers is not protected by attorney-client privilege and they can pass the info to employer. Not 100% sure though
This is my understanding as well. The lawyers work for the company, not you.
> Also, I heard that after I140 is approved you need to stay with the company for at least 180 days to safeguard your priority date Is this because the company can revoke your i140 within 6 months ? If so, do you know if MS does this ? Many large companies do not revoke.
When was the last time you’ve interviewed? If it’s been more than 2 years, then expect to take 6 months before you start getting offers. I’d say start now.
I am in my 3rd year of H1B, haven't started on the process yet. 🐼 Do you feel better now? I got laid off from my previous company, and I get a feeling I might be laid off in my current company😂
Dude, it's a long and tedious process. Better get started with it soon.
Stop worrying too much. You need to wait for 180 days and if not start looking for other job who sponsors visa and GC. Even if you have your perm and I-140 approved there are not many companies willing to sponsor.
