Ex-IBMer here. IBM recently sent me a letter stating that they overpayed me on commissions. The overpayment is over a silly amount ($800). They have instructed me to pay them or they will send me to collections. While they will technically "send me to a collection agency" I've heard from other past IBMers that this is not credit impacting. If I blow them off and don't waste my time with them will this affect my personal credit? Any past experience or advice is appreciated.
yes it will. VF Corp. kept payibg ne 6 months after I quit. had to return all the direct deposits and they had to deal with all the tax implications. was not simple.
What happened in your overpayment issues from VF Corp. I’m in a similar situation and did the collections from overpayment effect your score?
I got that and have ignored it. IBM managed to completely screw up my disengagement- took hours to clear up the expenses ($39k for three months). No one has personal contacted me and it's been six months. Hold onto it and tell them to get bent if they call. They're known for their incompetence, so don't sweat it.
IBM tried coming after me for 9K in expenses too. I never personally applied for the corporate AMEX they forced me to use and confirmed it can't effect personal credit. Told AMEX to figure it out with IBM and that I considered the matter closed on my end. They haven't contacted me since
I had a call every morning and night, just blocked the calls; but I did submit the paperwork by hand- IBM sucks
Did they actually overpay you?
No, they screwed up the date and then changed the termination date three times- total goat rodeo. I'm fairly sure they shorted me in the end; but by then I was too pissed to care
I dont believe most companies and collection agencies have the ability to place items on your credit history unless they are a licensed credit agency. Apex, that shifty home security company, screwed me and half my subdivision on our contracts. they sent me to collections for almost $2k. I told the collection agency to eat shit. they threatened to put it on my credit history. I told them they don't have the ability to do that. They asked for my SS#, I told them to eat shit. I blocked their number. They sent me collection mail. I returned them all. Eventually they sold the "debt" to another collector. Same run around. I told them to go to hell and to produce the original contract. They threatened credit report again. I said again they dont have the authority to do that. I refused. They stopped. 7yrs later, nothing on my credit report about it. FU Apex. I would have paid if I owed them, but they were crooks and had class action suits against them in numerous states. Collection agencies are thugs for hire with little power besides being annoying. YouTube John Oliver Collection Agencies.
I have this issue with Centurylink . Except it was for a relo bonus after they canned me. It's 10k they want and I keep telling them no. Finally they send me to collections they call give the usual threats I say sure give me a court judgement showing I'm liable and I'll pay . They get all excited and send me a copy of my relo contract. I explain that I don't interpret the contract the same way and they are welcome to sue me for it if they want but that no commission agreement or relo agreement is going on my credit because it wasn't a line of credit
14 months after the collection company looses it says they will sue hit my credit etc.... no word from them or Centurylink and nothing on my credit so all hot air Companies that large gank around with commissions so much they'd never be able to hold of up in a court of law
I got one of these after I left saying they overpaid me $1,600 in commission. I ignored it until the 3rd or 4th letter and then called the number and told them they spent 4 years trying to find ways to not pay my commission and I feel zero pity for them, and they can keep sending letters, but they’ll never see a cent from me. The person on the phone said not paying them back could hurt my chances of ever being rehired by the company some day. PLEASE - Promise me that. I don’t ever want to be back there. About a year later IBM recruiters started reaching out to me and I told them about my time there, the commission clawback attempt after I left, and told them not to call me again. I left 4 years ago and thank god. Final Note: I think the shakedown of former employees is a profit center so it’s another revenue generating tool to offset their declining revenues.
Good to know as I told them I wouldn't be sending them a cent, either. I'm sure they wish I did - they need all the financial help they can get..

Usually if anything is sent to a collections agency, it will absolutely impact credit as a derogatory mark. I wouldn't risk it.
I was thinking that... $800 isn't worth risking it. But if it's just some corporate IBM bullshit I figured I'd give them the finger and move on
