IBM offer declined - With approved I-140

My friend got an offer from IBM, but it was declined because he has maxed out 6 years on H1 but has a valid I-140 from the current company.
IBM has this policy saying the candidate should have at least 24 months left (out of 6 years) on their H1 for hiring. I felt its senseless because people stuck in the GC backlog & maxed out H1 cannot join IBM at all. I thought will share here and see of anyone has experienced/heard a similar situation.

Haha this is so funny. Why would anyone want to work there?

Even small and medium sized companies pay more than IBM.

Ask your friend to try else where. Other companies aren't very strict about it.

Can you name their past companies? Good companies? Proofpoint is hiring so ask them to apply!

“IBM does little work that is very unique. ”. How many other companies do quantum computers, AI, blockchain and cloud?

There are several companies doing cutting edge work in all of those fields @OTG.

    • Those are also either really, really small pieces of our business or numbers are being bloated.
Cloud we lose to AWS except when the our business folks get ahold of the metrics and perform the same voodoo they use on our financial reporting.
Blockchain is just a buzzword atm with no real large deals driving it.
Any deal that has any size component of Watson is being reported as AI earnings (i.e. $5M deal, if 100k of it is a watson component, all 5M is reported as AI earnings.)
Quantum computing is really, really, really small - R&D typed, I doubt many people get hired for that, but I concede that I don't have numbers

FB has a similar policy but managers can make an exception. IBM managers probably can too.

Sad to know... however, I wonder is it the 6 year boundary or the expiry of your current H1B? Sometimes if you renew you current H1B on 4rth or 5th year, then the expiry of that H1B will be in 7th or 8th year

Um, but you won't meet teams until the end of the process (bootcamp?) right? How does exception making work in that case?

This makes no sense, though. He can file a FOIA to get all his I-140 information and show it to IBM.

No need. He has a scanned copy of I-140 from his current company 🙄
