IBM offer declined - With approved I-140

My friend got an offer from IBM, but it was declined because he has maxed out 6 years on H1 but has a valid I-140 from the current company. IBM has this policy saying the candidate should have at least 24 months left (out of 6 years) on their H1 for hiring. I felt its senseless because people stuck in the GC backlog & maxed out H1 cannot join IBM at all. I thought will share here and see of anyone has experienced/heard a similar situation.

Haha this is so funny. Why would anyone want to work there? Even small and medium sized companies pay more than IBM. Ask your friend to try else where. Other companies aren't very strict about it.

Are there other companies in that area that are also innovative? IBM does little work that is very unique. There is a company out there for everything IBM does. I am sure your friend can find a great position somewhere else.

This makes no sense, though. He can file a FOIA to get all his I-140 information and show it to IBM.

FB has a similar policy but managers can make an exception. IBM managers probably can too.

Sad to know... however, I wonder is it the 6 year boundary or the expiry of your current H1B? Sometimes if you renew you current H1B on 4rth or 5th year, then the expiry of that H1B will be in 7th or 8th year

got a job offer from Kyndryl IBM and they are willing to do my H1B visa-Transfer. While accepting the job offer If I ask HR to process for I-140 within the first year of joining, will they agree? or not? I am in the first year of my H1B visa and still 5 years time remaining. so is it better to join the Kyndryl IBM or not ? is there any standard approach they follow in IBM or Kydnryl for employees on H1B to process for I-140? like 1) How long have they been employees of IBM 2) Employee performance or Skillset 3) Employee designation or job role etc... when they file for perm residency they have to 1st check if a qualified candidate is available and they have to follow the due process of the job advertisement.what if they found a suitable American candidate and employee who is on H1B visa has only 6 months left. @Autodesk I got job offer from IBM for band 8 and they are ready to pay 130k , where as my current salary is 100k from desi company and they are ready to sponsor I-140. How will be I-140 PERM process with IBM -Fragomen . is it better to stay or move to IBM? Please suggest.
