Don’t get in the car if you don’t want to. Otherwise mind your own business. People just trying to make a living.

      1) DMV clearly says “insurance follows the car”
      2) DMV clearly says insurance cover under “permissive” meaning “giving permission”
      3) just say you sorry and stop dude. It’s sad.

DMV did not say what you claim. For short uses it does, depending on State actually, but not for using it to drive for Uber!

Short story is these illegal immigrants are not insured while illegally driving Uber in violation of their visa.

The issue being debated is how this shady shit hurts anyone. It doesn’t. So what’s the big fucking deal. I don’t care who sucks who’s dick. It doesn’t hurt nobody so mind your own dick and stop worrying about everyone else’s dick.

      Why. Is. This. A. Problem.

Uninsured drivers are a problem and there is no way that Sandeep's insurance is going to pay for Rajiv's accident when they find out he was illegally driving Uber. No way does Sandeep have commercial fleet insurance on that vehicle and if he did it won't cover an illegal alien!

      That's the problem.

Also an American worker could have had that job, and the supply of illegal workers willing to work for nothing drives down wages for all Uber drivers.

By the way, I would include h4ead spouse in "American worker" so don't give me any idiot response about racism. Let somebody who actually followed the lawful immigration process get the work, and if no one wants it at the present wage then let wages rise until somebody does.

      exactly Tier 2.
      no issues with immigrants.

People on student visa(OPT) or work visa H1b aren't allowed to drive for Uber or Lyft. They can drive for scoop (considered as supplemental income).

I use Uber occasionally and even I've noticed that most of the students from Hyderabad drive for Uber (some of them even under a fake name) illegally. Next time I find one, I'm definitely going to email Uber to investigate the identify of the driver. It's important because these people misuse the loopholes in the law if they feel there won't be any consequences.

PS: I'm not saying everyone from that Indian state does this. There are good, law-abiding Hyderabad people here too.

"They can drive for scoop (considered as supplemental income)."

Where did you hear this? Scoop? or some immigration lawyer or USCIS itself?

Last I remember, the H1B allows you to work for your sponsoring employer at a specified location (high skilled, high tech etc). H1B does not allow you to "earn" any other way. Rent money, bank interest, dividends and capital gains from investments are considered passive income, hence allowed.

Earning money from driving a cab is earning, and participating in the labor market, which people on H1B, OPT are not allowed to do. Having said that, a lot of them do, and work at gas stations, convenience stores etc, which is all illegal and in my opinion should be reported.

I'd read that somewhere that scoop is a volunteering service (the drivers are not "employed" by scoop and they're paid directly by their ride-sharing peers), and that it's income is capped to a certain amount(around $300-$400 per month) which is not sufficient to be considered as a secondary source of income.

Not good enough info to risk your status over $400. Here is another bit of info for those not clear about labor laws - on a non-immigrant visa (h1, h4, f1, etc) you are not allowed to participate in the labor market at will, nor can you provide "volunteer service" if that service could have been provided by someone else for a wage/fee.
Avoid advising people on legal matters based on what you "read somewhere", or at least mention that you "read somehwere" if you do feel the urge to post.

I read some legal website :
a position is considered as volunteering as long as the job provider declares it to be an unpaid volunteer position and it does not replace any american's job.
means, one can not work on a gas station for free if some american can get paid for the same job.
thats why community college students working as volunteers in places like hospitals are really volunteer positions

Uber and Lyft just ask for a social security number and DL. They are not actually checking for immigration status. This is a massive loophole in the system -- employers are required to check the status of their employees on e-verify before running their payroll. However, Uber/Lyft drivers are supposed to be independent contractors so they are not being verified.

Your observation that many Indians are driving illegally is correct. I am an Indian scientist and currently on H1B myself. I went to grad school in the US so I am very familiar with student visa system as well. I have been picked up by Indians several times in the Bay area and while traveling around the country, and I can immediately tell they are not legally authorized to drive for Uber or Lyft.

There is one specific region of southern India where most of these folks come from - two states of Andhra and Telangana. The folks of that region have figured all ways of exploiting the visa system and settling cheap unskilled labor in the US on H1Bs and green cards. There is really very low respect for rules in that community so it is not surprising at all.

It is not just Indians though, international students from all over are driving illegally. The student visa specifically states that you can not take an employment opportunity outside your school, or as authorized by the school (internships related to degree). I have been picked up by an African and middle eastern students several times while traveling in the DC area - I can figure out within 2 minutes of a conversation that they are not supposed to be doing this.

They need to be citizens or have an EAD Card . If not , they are breaking the laws . Law does not even allow one to drive on OPT visa . IRS mandates that if you are earning > .63$ / mile , it is not for reimbursement but for supplementary source of income .

I could provide you referral link for scoop or for Waze carpool but I would not be anonymous anymore

Uber should have its ability to operate suspended until or unless they get on top of this issue. No one should be driving Uber who hasn't been properly screened for good driving record or who doesn't carry valid insurance.

Also I think you should not be driving Uber at all unless you have a minimum of five years clean driving record in the US. These students probably haven't even been in US five years. Who knows how many accidents they caused in India.

Come to think of it though, it was worse before Uber. I used to live in NYC and all the taxi drivers there were illegal immigrants from Northern African countries. And there was no way to rate/report bad drivers. With Uber's rating system, you can very quickly get a bad driver out of the system.

Yeah, if those driving with fake name get into an accident and you are injured don't expect there will be any insurance coverage to pay your medical bills. For sure they are uninsured drivers.

Give me yours so I can report you to USCIS for illegally driving Uber without insurance. Commercial use isn't covered by lending you car to an illegal alien.

TLDR; people who drive without insurance are a menace regardless of where they come from; illegals working on student visa can't get insurance to do that and shouldn't be driving Uber
