Hi, Most ppl need to apply for Advance Parole before they travel outside of US while their I485 (adjustment of status) is on pending. For L1/L2 i heard that it is not required. Anyone has experience on this? Thx
You still technically need AP on L1/L2. The only change the USCIS has made is that generally, if you do leave the country without an approved AP, they will only cancel your pending AP now, not your entire process. Previously they would cancel your entire GC process. Ensure you have a valid visa however, otherwise your re-entry will be denied. Check with your attorney in case there is anything specific to your case. A brief overview of each situation: - Valid L1, pending AP: You can leave & re-enter on the L1, but the pending AP will be abandoned. Your GC application will NOT be abandoned - Expired L1, pending AP: You should not leave. You do not have any means to re-enter the country and your GC application will be considered abandoned. - Expired L1, approved AP: You can leave & re-enter using the EAD/AP combo card. Your GC application will NOT be abandoned
Yep. Travel and return as long as you have valid L1 you are fine. Pending i-485 does not impact your current nonimmigrant status
