And also company should not ask for visa expenses. It’s company expense and candidate should not pay. But if they spent money on something else like relocation money or signon bonus, you might be liable to pay back.

The company can always charge you fot the attorney fees as this is not covered in the law that they cannot. Also, they can also charge you for the PP fees, since the USCIS site does not strictly define who the actual beneficiary is

So OP looks like it was mentioned in the offer letter and you accepted it and you signed it and they started processing your visa and then you withdraw. if this is the case you need to pay. there's nothing wrong what the company's doing. It's you who is the withdrawing from the agreement not the company. You can say whatever you want to say but in the end I'm sure it's all legal what they're doing. OP what exactly do you mean by I'm declining the offer? Looks like you already accepted the offer and they started processing your visa and now you are backing out?
