Legal defense for discrimination?

I feel like my manager has been giving me a lot of unfair qualitative feedback to evaluate my performance and no metrics to measure my half yearly performance. I also believe that he discriminated based on my nationality. He has hinted that he is going to put me on pip. How can I defend myself legally before I get laid off and what proof can I save to sue him for discrimination?

What’s your nationality and what’s his?

    The first point isn’t actionable.

As to discrimination on the basis of nationality, you’d need written documentation or some ability to prove that was the reason for disparate treatment.

Well he discriminated verbally, how can I have proof of that?

Exactly. You’ll need to prove a pattern and practice of discrimination.

Start now. Create a journal note date and time of anything he says. Share with someone you trust. If he puts you on a pip tell your hrb that you have concerns that your manager may be discriminating. Share your journal but do not give them your only copy. If he doesn't start taking positive action within 1 week retain council. Follow their advice from that moment forward

It’s a really small startup, there is no real hrbp.

Ok then all of the above except contacting hr. Hostile work environments based on race are illegal but you need documentation. A journal is a good start. Anything you can get in writing from him is better. If there are witnesses other than yourself. Shell out 1k and talk to a lawyer

Your manager can fire you for no reason. Communicate in email and archive it to your own personal archive.
