My starting date with new employer is X. However i have a bunch of RSU from my current employer vesting on X+3 days. I was wondering if there is any way to collect these. My thinking was to make a resignation notice 2 weeks prior to that. Agree on my last day in office to be X-1. And take the remaining vacation days which will bring me to officially last day at work to be X+3 (RSU vesting day). And start with new employer on the agreed date X. That means that although i will be going to work with my new employer on day X i will still be on payroll (though vacation one) for 3 days with my old employer. Is that doable? Is that legal?
Bet your current contract says something about not working for another employer while you are employed by them. Why take the risk? If it were me, I wouldn't even give notice until after I have received my RSUs
3 days seriously? Push it a week.
Push joining by 1 week.
I was pushing the new employer far enough, they were nice enough to accommodate. I cannot ask them to push further.
You’re willing to consider risking the job by working two places at once, but you won’t simply ask for another week? For goodness sake the worst they can do is say no.
I guess my worry is whether this scheme that i'm thinking of is illegal and will get me in some kind of trouble with my new or old employer
It’s not illegal but probably violates agreements you’ve signed.
Not illegal but violates employment contract with apple and probably your new empmoyer
Are you in a work visa? If you are GC/citizen I guess no one will ever know or care. On visa you would want to make sure the overlapping dates don't create a visa issue (ie, not actually authorized to work for both).
I'm a GC holder, so visa is not a problem. I guess the violation of employment agreements might get me in trouble - so seems like it's not worth the risk
I know a guy who tries to do this (albeit by nearly a month) - he told our team he was going to be in China for a month, as he had a ton of PTO accrued He got caught because both companies used the same outside benefits provider. From his experience: 1) its not illegal in a criminal sense. 2) it was grounds for termination and he did not collect the options, but otherwise they couldn't do jack, and he still got his vacation balance paid out 3) i have no idea if the new company found out or not but he was there several years after.
Sounds really optimistic. The best would be to push your start date back a week.
