Microsoft has a major change in green card policy likely due to lay-off

Reconsider if you want to join this company. Now they stopped perm program, and anyone who has sufficient time left in their h1b or has a pd from previous employer will be depriotized in their queue. Delay could be 1-2 years. Their immigration team and leadership has no transparency on this major change, and refuse to response to employee inquiries. If you have a Microsoft offer or thinking about moving here when still on visa, please be aware your green card process will be significantly delayed as compared to joining other companies.

There has been history that Microsoft internally paused perm for one year when they need to lay-off people. They constantly do this almost now and then, and in secrete. The stories weren’t publicated to outside audiences so innocent people become victims of this ill policy again and again. These people could have a brighter future and well planned career and life elsewhere.

    If green card is your life goal, I’m not sure you fit in the company. A business passion makes people move forward. If you only optimize your life based on the green card, I’m not sure how much it benefits to your life. There are citizen who even don’t have a home anyhow. Microsoft immigration is capable and they make sure it will not affect the job. I totally understand the desire for the green card, but only focusing on green card while ignoring the bigger opportunity is not wise either.

      No one said he ONLY focused on it, but it's a big issue. If Microsoft lays you off (and Microsoft does have annual layoff) then you're kind of screwed if you're on a work visa.

      Agree with VMware and Amazon. There are opportunities everywhere. By ‘bigger opportunity’, I guess you refer to Microsoft has the best opportunity. That makes no sense. There is internal thread that quite a few employees complaining that they have been deceived when signing on the offer. If they know this policy no matter how big of the opportunity is, they wouldn’t go for it.

      This could be because of 2 things among many:
      1. Microsoft paused all the PERMs
      2. Shittiest Law Firm - Fragomen.
      What else do you need to screw yourself on Work Visa when Fragomen is your attorney?

    PD from previous employer getting deprioritzed makes sense if it's far in the future. What's the point in updating it? You're likely going to be at another employer when it comes due anyway.

    Lots of legal paperwork for no benefit to anyone there.

    I am from Microsoft and I confirm this is authentic. Please pardon me for not willing to share the pictures due to legal concern, but I can confirm this is true.

    For those who choose not to believe it because there is no screenshot: when people join a company they sign a non-disclosure agreement. Law won't stop to function just because we are anonymous on Blind. More than two people already confirmed - that's the best thing we can do.

  • Hmm so I'm freaking out a little over this. I accepted an offer from them towards the end of last year. They promised they'd get on my GC application as soon as I start. Transfer application ended up getting an RFE, and they're working on a response (due end of April). They've been super responsive about everything so far, but considering this will be my 2nd term of the h1b (extension), I'm a little worried if this new policy might prevent them from applying for my perm. Otoh, my company had a round of layoffs this month, so they won't be able to apply for my perm until at least October, and I've heard rumors that there is another round coming, which would further push out the eligibility date. I don't know what to do at this point...

    • No sap hasn't even started the process yet. I'm taking a leap of faith and jumping ships if it gets approved. They have been waiting since September, they won't wait any longer. And I have lost all faith in sap at this point.

      Makes sense because if you have an established PD with a I140 that is older than 6 months MS can keep extending your h1b even if that I140 is from a previous employer. This is a money saving tactic and a tacit admission that Indians stuck in the GC queue will not get their GCs in this life time.

    IF there is a layoff, those will be jobs which don’t contribute to the business that much anymore. Is your job not important? If you view that way, I doubt you take the job because of the passion. There are indeed a lot of opportunities, take whatever you think is important for you.

      I was stupid to take the job because of passion for the business and ignored all realistic factors. And My job is important to the business and I’m very sure my category won’t be laid off. But this policy change is still very shocking to me and many others, and impact our lives and careers significantly negatively.

    Sounds like the company is gearing up for a major staff reduction. They won't want to have an excessive number of applications for foreign workers in flight if they are laying off Americans as that causes legal issues.

    They have a priority list for whom to put on each labor market test. If you are low risk in losing work authorization, you will always be depriortized to be proceeded in the perm process. Think about how long will it take until it’s your turn.
