Moving back to USA on H1B from India

I have approved I-140 for what it's worth and want to move back to USA from India.
I was in us 3 years back for 4 years, should I target some specific companies?

Is it possible please share your experience.

  • Did the same thing couple of years ago. Interviewed with Snap and FANG and hedge funds. Got a bunch of offers and all of them were willing to sponsor h1b (also had gotten an B1 for onsite interviews).

    So step 1, get a B1 (don't say you wanna go and interview, say you are visiting your friends). Step 2 interview a bunch. Step 3, $$$

    • No. working on B1 is illegal. Searching a job is illegal. But going and attending a business meeting on a business Visa isn't illegal.

    • Lol ask the US immigration law makers. Also B2 is a tourist visa, B1 isn't. You flying out to meet a team can be considered a business meeting.

      Yes. But meeting the team is different from interviewing is my point. Don't you have to provide justification/documentation for meeting the team?

      I interviewed 5 years ago at FB. Did fly with B1 and even had a letter from FB if immigration asked about reason of trip. So yeah itโ€™s legal.

    • B1 is the visa for interviewing. How else are companies supposed to hire from abroad, if they can't invite people over for interviews?

    • I also got the B1 to interview at FB in 2014.
      I even told the visa officer back then that I'm going to interview at fb and he also congratulated me + wished me good luck.

      However, 2019 is not 2014. So things might have changed.

      Legally (strictly) itโ€™s illegal to interview or search jobs on any B visa and equals to federal prison which is very much possible and is now common

    The whole h1 approval at this point is crazy. Even folks from fb, Google and other large companies are getting RFEs. While many get approved, it's unnecessary confusion. Also, i140 is shit if you are Indian. Your PD isn't like 2009 to process. Every year you are away from GC you are 10 years away. So without any real reform, you have to renew every three years. Renewals used to be low risk paperwork. That isn't the case. Folks with 10-15 years in fang are being handed RFEs. I know of 2-3 people at Google personally, who have left because of uncertainty over their visa (also for example because their spouse couldn't reliably work etc).

    Not saying you shouldn't come - but acknowledge these risks.

      Are you saying your H-1B can be denied even if you have filed I-140? Then what is preventing you from trying again and again? Youโ€™re not subject to the quota.

      You will but itโ€™s a waste of time for them to deny them because you can always reapply and the I-140 gives you the right to do so. They can never deport you.

      Lol. Again, you are talking like how it was several years ago. You should ask why my friend at Google who is L6 left US for India due to visa issues.

      Again, guaranteed renewal with i140 is a thing of the past. There is no logic in what USCIS does. The only logic I can see is make things harder.

      Also note, companies only have limited time - they won't keep trying again and again 100 times. Check the group here on how folks are getting pissed with Bal and fragomen who take 3 months to do a h1 renewal.

      Also consider possibility of the lawyers screwing your petition, causing denial. Happened for one of my friend. If you have a spouse who has work depending on h4 EAD, a kid whose schooling will be in confusion if you can't move on time, you will quickly see how this makes everything hard.

      Again just acknowledge these are real issues and prepare a plan B for these. That's all I am saying.
